ID & credible witness requirements

BEFORE YOUR APPOINTMENT

Acceptable identification.

Common ID

  • Generally current or issued within the past 5 years.
  • California DMV Driver’s License or ID.
  • U.S. Passport.
  • Qualifying California prison or sheriff-issued inmate ID while in applicable custody.

Other qualifying ID

  • Must meet validity rules and include photo, description, signature & identifying number.
  • Other U.S. state Driver’s License or ID.
  • Authorized Canadian or Mexican Driver’s License.
  • Valid foreign Passport or Consular ID from your country of citizenship.
  • Qualifying U.S. Military ID; some lack required details.
  • California state or local government Employee ID.
  • Federally recognized Tribal Government ID.

Two credible witnesses

  • Arrange with Herica in advance; forgetting ID alone does not qualify.
  • Both appear with you, show qualifying ID & sign the journal; knowing the notary is unnecessary.
  • Under oath or affirmation, each confirms they personally know you as the named signer.
  • Each reasonably believes your circumstances make obtaining ID very difficult or impossible.
  • You possess no identification authorized by California law.
  • Neither witness is named in or financially interested in the document.

Credible witnesses establish identity, not document witnessing. Herica must confirm all requirements. Ask about expired, unusual, or missing ID before booking. California Notary Public Handbook (PDF) · California Civil Code §1185.

Legal advice: I am not an Attorney and cannot give legal advice, prepare documents, or choose your notarial certificate. Ask your Attorney or document provider which certificate is required and how to complete your documents. Bring complete documents and qualifying ID; leave the notary certificate for the notary. Notarization does not establish a document’s legal validity. Forms are general-information resources.
